1.2. The provisions of these Terms and conditions are not intended to exclude or limit any rights of the customer who is at the same time a consumer under mandatory legal provisions. In the event of non-compliance with these provisions, the provisions shall prevail.

1.3.2. INDIVIDUAL VALUATION of the REPORT – an electronic service consisting in the transmission by the service provider to the e-mail address indicated by the service recipient of a personalised hyperlink to the individual valuation of the report located on the website Service provider. The individual valuation of the report presents in the variations the scope of information available in the report. This information shall include a statement of the availability of information in the selected variant of the report and the cost of such report. However, the individual valuation report does not contain the report itself.
1.3.3. CIVIL CODE – Law of the Civil Code of 23 April 1964 (OJ 1964 No. 16, item 93, as amended).
1.3.4. VIN NUMBER – A unique identification number specific to the motor vehicle, consisting of a maximum of 17 characters (Letters and numbers) (Vehicle Identification Number).
1.3.5. PAYPAL – PayPal (Europe) S. à R.L. & Cie, S.C.A. with its registered office in Luxembourg (registered address: 5. Storey, 22 – 24 Boulevard Royal, L-2449 Luxembourg), which supports electronic payments via the http://www.paypal.pl/service.
1.3.6. VEHICLE – a mechanical vehicle with a VIN number indicated by the customer.
1.3.7. REPORT – An electronic service consisting in the transmission by the service provider to the e-mail address indicated by the service recipient of information about the vehicle in the form of an electronic report. The scope of information is available in the chosen variant of the report obtained by the customer in the individual valuation of the report.
1.3.8. TERMS and CONDITIONS – this website terms and conditions.
1.3.9. INTERNET Service – Service of the service provider available at the Internet address www.passioncars.pl.
1.3.10. ELECTRONIC SERVICE – A service provided electronically by the provider to the customer through the website.
1.3.11. CUSTOMER – a natural person with full legal capacity, a legal person or an organizational unit with no legal personality who uses the electronic service in accordance with the terms and conditions.

1.3.13. INQUIRY – Electronic service available on the website allowing the transfer of data to the service provider, which is needed to create an INDIVIDUAL VALUATION of the REPORT.
1.3.14. The service provider is obliged to deliver the product without defects subject to the provisions of regulations.
1.3.15. 2. ELECTRONIC SERVICES ON THE WEBSITE
2.1. The following electronic services are available on the website: inquiry, individual valuation report, report.
2.1.1. Inquiry – Use of the inquiry is possible by navigating to the query hyperlink on the website where the form is available. The form must provide the following data: Name/company/nickname, E-mail, vehicle VIN, Link to announcements, comment. In the inquiries form it is necessary to provide the following data of the customer: Name and surname/company/Nick, E-mail and VIN of the vehicle.
2.1.2. Individual valuation of the report – Use of the individual valuation of the report is possible after a total of two consecutive steps-(1) administration on the website of the Web site in the hyperlink enquiries of the necessary data of the customer and (2) Click on the field “Send Inquiry”.
2.1.3. Report – The use of the report is possible after obtaining a personalized hyperlink to the client’s e-mail address for the individual valuation of the report. In the individual valuation of the report, the client selects one of the available options for the report. The selected variant of the report is made available after a total of two consecutive steps-(1) Click on the “Pay” field for the selected report variant and (2) make the payment.
2.1.4 The service user is obliged to use the Web site in a manner consistent with the law and morality with respect for the personal and intellectual property rights of third parties. Unlawful acts that may impede the operation of the website or expose the service provider to loss of reputation are prohibited.
2.2. The service recipient is prohibited from supplying content of an unlawful nature. The customer is obliged to enter data in accordance with the facts.
2.3. The technical requirements necessary to cooperate with the electronic system which the service provider uses:
2.3.1. Computer, tablet, phone or other multimedia device with Internet access.
2.3.2. Web browser installed on a device with Internet access: Mozilla Firefox version 10.0 and higher, Internet Explorer version 8.0 and higher, Opera version 11 and higher, Google Chrome version 17 and higher.
2.3.3. Cookies are enabled in the Web browser.
2.4. The inquiry and individual valuation of the report are provided free of charge.
2.5. Report sharing is chargeable – the price of the report is given on the website of the Web site, after the service recipient has obtained a personalized hyperlink to the e-mail address for the individual valuation of the report. The prices of the reports are given in Polish zloty or euro. This price is the total prices, including taxes and any other fees.
2.6. The query is provided for an indefinite period. The individual valuation of the report and the report are one-off and are terminated when the individual report or report is made available.
3. SPECIFIC CONDITIONS FOR THE REPORT
3.1. The cost of the report and the variants of available reports are given each time for the vehicle on the website of the Web site, after obtaining a personalized hyperlink to the e-mail address for the individual valuation of the report. For the provision of the report, it is necessary to obtain a personalised hyperlink for the individual valuation of the report by the service recipient.
3.2. The report is only ancillary (additional) and should not be the sole basis for deciding whether or not to conclude a contract for the sale of a vehicle by the customer. If there is any doubt about the origin of the vehicle, its mileage or history, it should be verified with the relevant authorities of the State or third parties assisting in this respect. The service provider recommends in any case (even in the absence of doubt) contact the above authorities and third parties in order to verify the vehicle before deciding to conclude a contract of sale.
3.3. Information and events about vehicles made available through the report originate from sources external to the service provider. The role of the service provider is limited in this case only to their making available to the customer through the website. The service provider does not verify the accuracy, correctness and veracity of the above information and events about vehicles.
3.4. The customer acknowledges the fact that the service provider collects data from multiple sources for use in the report. The data collected may duplicate errors and contain incomplete information. The customer understands and acknowledges that not all information may be available, complete and correct. The information on the report is of an auxiliary nature only. The customer acknowledges and understands that the information contained in the report cannot clearly state the facts of the vehicle, and the responsibility and decision to purchase the vehicle belongs to the customer. The service provider makes no warranty as to the correctness of the data and completeness of the report.
4.1. The service provider provides the following payment methods:
4.1.1. Electronic payments via the DOTPAY service-possible payment methods are available on the website before making payment and on the website http://www.dotpay.pl/.
4.1.2. Electronic payments via Paypal (https://www.paypal.com/pl)
4.2. Credit card and online transfer transactions are settled through the Dotpay Billing centre.
4.3. PayPal transactions are settled via PayPal.
5. COMPLAINT PROCEDURE
5.1. Complaints relating to the provision of electronic services:
5.1.1. Complaints relating to the provision of electronic services by the service provider via the website may be filed within 30 days of the finding of irregularities in particular by sending a message to the e-mail address: email@example.com and in writing to the service provider’s address. It is sufficient to send a notice before the deadline expires.
5.1.2. Complaint, please include at least the name of the service recipient; Mailing address; Description of the circumstances concerning the subject of the complaint. In case the complaint relates to the report in addition (when the data is available): the date of purchase of the report; Payment date for the purchased report; The type of report purchased and the transaction amount.
5.1.3. Consideration of the complaint by the service provider occurs immediately, no later than within 14 days from the date of receipt of the complaint report. The reply of the service provider on the complaint is sent to the e-mail address of the customer specified in the complaint or otherwise indicated by the service recipient.
6. RIGHT TO WITHDRAW FROM THE AGREEMENT
6.1. A customer who is also a consumer who has entered into a distance contract with the service provider in the form of purchasing the chosen variant of the report, but has not obtained it, may withdraw from it without stating the reasons, by submitting a statement within fourteen days. It is enough to send a statement before it expires. The fourteenth day period in which the consumer may withdraw from the contract shall be counted from the date of the issue and, where the contract relates to the provision of the service, from the date of its conclusion.
6.2. The right to withdraw from a distance contract shall not be granted to the consumer in respect of contracts: (1) for the provision of services, if the service provider has fully performed the service with the express consent of the consumer, before the expiry of the period referred to in paragraph 6.1 above; (2) The provision of services with the properties specified by the consumer in his order or closely related to his person; (3) The provision of services which, by virtue of their nature, cannot be reimbursed.

8.2. The customer may view the materials published on the website, including as part of the electronic services provided, as well as to download individual copies of these materials, within the limits permitted by law, for personal use only.
8.3. It is forbidden to use the content and logos posted on the website in any way other than as indicated in these terms and conditions or by mandatory legal provisions.
9. FINAL PROVISIONS
9.1. Contracts concluded through the website are concluded in accordance with Polish law and in Polish.
9.2. In matters not governed by these Regulations, the provisions of the Civil Code shall apply; Act of 30 May 2014 of the Year on Consumer Rights (Journal of Laws 2014, item 827), act of 18 July 2002. On the provision of Electronic services (Journal of Laws No. 144, item 1204, as amended) and other relevant provisions of Polish law.
9.3. Changes to the regulations:
9.3.1. The service provider reserves the right to make changes to the regulations for important reasons it is: changes to the laws; Changes in payment methods; Changes in the scope, payment or form of electronic services provided, changes to the seller’s address-to the extent that these changes affect the implementation of the provisions of these Terms and conditions. The amended regulations shall be binding on the service recipient if the requirements set out in art. 384 of the Civil Code, i.e. The customer has been properly notified of the changes and the customer has not declared a continuous electronic service contract within 14 days from the date of notification.
9.3.2. However, amendments to the Rules of procedure will not in any way infringe the rights acquired by customers who are simultaneously consumers within the meaning of art. 22  of the Civil Code and using the website before the date of entry into force of the changes, who in such cases have the right to use the Web site on the basis of existing rules. In the event that the amendment of the regulations resulted in the introduction of any new fees or an increase of the current service user who is a consumer has the right to withdraw from the contract.
9.4. Dispute Resolution: Disputes arising between the service provider and the customer who is simultaneously a consumer shall be subjected to the relevant ordinary courts. Disputes arising between the service provider and the customer who are not at the same time the consumer shall be subjected to a court of competent jurisdiction on the basis of the provider/seller’s seat.
